1. Definitions

Service means BrightMoon's AI-powered image, video, upscaling, enhancement, face swap, account, credit, and related features, operated by BrightMoon Labs LLC.

User, you, or your means any person or entity that accesses or uses the Service. Content means prompts, images, videos, files, references, uploads, and other materials you provide.

AI Outputs means images, videos, or other results generated or modified through the Service.

2. Use of the Service

We grant you a limited, non-exclusive, non-transferable permission to use BrightMoon for personal or commercial purposes, subject to these Terms and applicable law. You are responsible for your account, activity, prompts, uploads, outputs, and use of credits.

3. AI Output Disclaimer

BrightMoon relies on AI systems that are probabilistic and continually evolving. Outputs may be inaccurate, unexpected, offensive, incomplete, or different from your instructions. You are responsible for reviewing outputs before using, publishing, or relying on them.

4. Content Ownership and License

You retain ownership of content you upload, subject to rights held by others. You represent that you have the rights and permissions needed to upload and process your content. By using the Service, you grant us a limited license to host, process, transmit, and display your content solely to provide, secure, support, and improve the Service.

5. Prohibited Uses

You may not use BrightMoon to create, upload, request, or distribute:

• Illegal, harmful, fraudulent, or deceptive content.
• Sexual content involving minors or any exploitation of minors.
• Non-consensual intimate imagery or abusive deepfakes.
• Content that violates privacy, publicity, or intellectual property rights.
• Hateful, harassing, defamatory, violent, or threatening content.
• Malware, spam, automated abuse, scraping, or attempts to bypass limits.

We may suspend or terminate accounts, remove content, limit access, or refuse refunds when these Terms are violated.

6. Payments, Credits, and Refunds

BrightMoon may offer paid credits, subscriptions, or other paid access. Payments are processed through third-party payment providers such as Stripe. Credits are consumed when you submit eligible generation or processing jobs. Unless required by law or stated in our Cancellation Policy, purchases are final and refunds are not guaranteed for outputs that do not meet expectations.

7. Account Suspension and Termination

We may suspend, restrict, or terminate access if we believe you have violated these Terms, created risk for BrightMoon or other users, attempted abuse, failed to pay, or used the Service unlawfully. You may stop using the Service at any time.

8. Intellectual Property

BrightMoon, its software, branding, design, workflows, models, documentation, and related technology are owned by us or our licensors. These Terms do not transfer any ownership of BrightMoon intellectual property to you.

9. No Warranties

The Service is provided “as is” and “as available.” We do not make warranties that BrightMoon will be uninterrupted, error-free, secure, or that outputs will be accurate, lawful for your intended use, or fit for a particular purpose.

10. Limitation of Liability

To the maximum extent permitted by law, BrightMoon and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunities arising from your use of the Service.

11. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page. Continued use of BrightMoon after changes become effective means you accept the updated Terms.
